Please read these Terms carefully. By downloading, installing, or using the Ping1 application or website, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1 Acceptance of Terms

These Terms and Conditions ("Terms") form a legally binding agreement between you ("User") and Arios Web Technologies, the operator of the Ping1 service ("Ping1", "we", "us").

By accessing or using the Ping1 mobile application, website at https://www.ping1.in, or any related service (collectively the "Service"), you confirm that you:

The Service is operated on a best-effort basis. We do not guarantee specific uptime, check frequency, or notification delivery times.

3 Eligibility & Account Registration

To use the Service you must:

You are responsible for maintaining the security of your Google account. Ping1 is not liable for any loss resulting from unauthorised access to your Google account.

You may not create multiple accounts or share your account with other individuals.

4 Admin Approval Process

Ping1 operates an invitation-by-approval model. After registration your account will be in a PENDING state. Access to monitoring features is granted only after a Ping1 administrator reviews and approves your account.

We reserve the right to approve or reject any account application without providing a reason. Approval is not guaranteed.

If your account is rejected, you will be notified via push notification. You may contact support@ping1.in to appeal.

5 Acceptable Use

You agree to use the Service only to monitor targets that you own, control, or have explicit written permission to monitor.

Prohibited uses — zero tolerance:
  • Monitoring IP addresses, websites, or ports that you do not own or have no permission to scan.
  • Using Ping1 to facilitate denial-of-service attacks, network reconnaissance, or penetration testing without authorisation.
  • Adding monitoring targets to probe or enumerate third-party infrastructure without consent.
  • Attempting to reverse-engineer, decompile, or circumvent any part of the Service.
  • Sharing your account credentials with others.
  • Using the Service for any unlawful purpose under applicable Indian law or international law.

Violation of these rules will result in immediate account suspension and may be reported to relevant authorities.

Webhook URLs

If you configure outbound webhook URLs, you are solely responsible for the security and behaviour of those endpoints. Ping1 will POST JSON payloads to your URL on status changes; we are not responsible for data handling at your webhook destination.

6 Monitoring Targets & Limits

Each account has a default monitoring limit set by administrators. Current defaults:

Limits may be changed at any time by administrators. The global check interval is set by the system administrator and may override per-user settings.

We reserve the right to throttle or suspend monitoring for accounts that generate excessive load.

7 Intellectual Property

All content, branding, source code, and design elements of Ping1 — including the Ping1 name, logo, and trade dress — are the intellectual property of Arios Web Technologies and are protected under applicable Indian and international law.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Ping1 application for its intended purpose. You may not:

Your monitoring data (targets you create, results generated) remains your property. You grant Ping1 a limited licence to store and process this data solely for the purpose of delivering the Service.

8 Disclaimers & Limitation of Liability

Service provided "as is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or uninterrupted service.

No guarantee of monitoring accuracy

Network conditions, firewall rules, and infrastructure changes may affect the accuracy of checks. Ping1 cannot guarantee that every downtime event will be detected or that every notification will be delivered.

Do not rely solely on Ping1 for monitoring critical production systems. Always maintain independent alerting mechanisms for mission-critical infrastructure.

Limitation of liability

To the maximum extent permitted by law, Ping1 and Arios Web Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business arising from:

Our total aggregate liability to you for any claim shall not exceed ₹1,000 (Indian Rupees one thousand) or the amount paid by you to us in the three months preceding the claim, whichever is greater.

9 Service Availability & Changes

We strive to maintain high availability but do not guarantee any specific uptime SLA for the free tier of the Service.

10 Account Suspension & Termination

We may suspend or permanently terminate your account, with or without notice, if:

You may delete your own account at any time by contacting support@ping1.in. On deletion, your personal data will be removed as described in our Privacy Policy.

11 Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India, specifically including but not limited to the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, without regard to conflict of law provisions.

Any dispute arising from these Terms or the use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Tamil Nadu, India.
